In Poland, similarly like in other Community Countries, provisions of the CLP Regulation (Regulation (EC) No 1272/2008 of the European Parliament and of the Council of 16 December 2008 on classification, labelling and packaging of substances and mixtures, amending and repealing Directives 67/548/EEC and 1999/45/EC, and amending Regulation (EC) No 1907/2006) are implemented directly to the national law, but the additional, local regulations also have to be taken into consideration, in particular the Act on chemical substances and mixtures (Journal of Laws No 63, item 322) as well as the range of executive regulations. In relation to the above, simple conversion of rules for placing the substances and mixtures on the market in accordance with the CLP Regulation is not possible in Polish reality. A very important role is played here by the language issues (translations), specific nomenclature and requirements of additional regulations.
The CLP system includes harmonised criteria for the classification of chemical substances and mixtures, regarding the hazards to human health and to the environment. It also contains the harmonised rules concerning notification of hazards, including the requirements for labelling and safety data sheets. Also the risk phrases, hazard symbols and signal words are harmonised as well, in order to create an integrated system of hazard notifications.
In order to implement the change of classification systems in a possibly smooth manner, some transitional periods were introduced, when it is allowed to use the „old” EU system and the new CLP one (there are separate transitional periods for substances and mixtures):
- from 1 December 2010 to 1 June 2015, substances are classified with the use of provisions of both, CLP Regulation and Directive 67/548/EEC (current classification). Substances are labelled and packed solely in accordance with the provisions of the CLP Regulation.
- until 1 June 2015 mixtures are classified, labelled and packed in accordance with the current regulations, but the use of the classification and labelling compliant with the CLP Regulations is also allowed.
- from 1 June 2015, for both, substances and mixtures, solely the provisions of the CLP Regulation apply.
New CLP system is significantly more complex in use than the current UE classification, and it results in more complicated process of safety data sheet compilation and placing the right content on the product label.
